My HOA architectural request was denied. What now?

A denial is often not a final no. Many are really "incomplete" or "not enough information", and a clean resubmission gets approved. Here is how to work out which one you have and what to do.

1. Read the decision for the actual reason

Look for one of these:

  • Incomplete: a missing site plan, colour, dimensions or neighbour sign-off. Fix and resubmit.
  • Doesn't meet a specific guideline: for example height over the limit or a colour not on the palette. Change that one element, or ask whether a variance is possible.
  • No reason given: ask in writing which guideline section the decision relies on. Many governing documents require the committee to explain a denial, and some allow you to request a hearing or appeal to the board.

2. Check your governing documents

Your CC&Rs and architectural guidelines usually say how long the committee has to respond, whether an appeal to the board is possible, and how to request it. Some say a request is deemed approved if the committee doesn't respond within a set time, and others say the opposite. Read the exact wording. State laws differ, and if the stakes are high (for example the HOA is demanding you remove something), talk to a lawyer licensed in your state. This guide is general information, not legal advice.

3. Resubmit so the yes is easy

  • Address every reason in the decision, one by one, in a short cover letter.
  • Quote the guideline sections and show how the revised project meets each one.
  • Add a site plan with setbacks and dimensions, even if they didn't ask for one.
  • Include product photos and exact colour names.
  • If neighbours support it, include signed acknowledgements.
  • Ask to be on the next meeting agenda, and attend if owners may speak.

4. Keep a paper trail

Save the original application, the decision, every email and the dates. If you appeal, a clear timeline and a complete resubmission are your strongest tools.
