HOA solar panel approval request: letter template, checklist and your rights

Most HOAs require architectural committee (ARC or ARB) approval before rooftop solar goes up. In many states the HOA cannot ban solar outright, but it can still review placement and appearance and set reasonable conditions. A clear request with the installer's layout usually gets approved in one meeting.

Check your state's solar access law first

A number of states, including California, Florida, Texas, Arizona and Colorado, have solar access or solar rights laws that limit how far an HOA can restrict solar panels. Typical protections stop an outright ban and stop conditions that significantly raise cost or reduce output, while still allowing the HOA to require approval and reasonable aesthetic rules. The details and deadlines differ by state, so look up your state's statute (search "[your state] solar access law HOA") and cite it in your letter if it applies. The HOA rules to look up

  • Placement: some guidelines prefer panels on roof planes not facing the street, where that does not cut output much.
  • Appearance: flush mounting, black frames and back sheets, hidden conduit, conduit painted to match the wall.
  • Ground mounts: usually treated separately, with setback and screening rules.
  • Review deadline: your CC&Rs or state law may say how many days the committee has to decide.

- Placement: [rear and side roof planes only; no panels on the street-facing roof].
- Mounting: flush to the roof, no more than [6] inches above the surface.
- Appearance: [all-black panels, black frames and rails]; conduit run [in the attic /
  along the [side] wall, painted to match the siding].
- Equipment: inverter and disconnect on the [side] wall, [screened / not visible
  from the street].

Attachments committees ask for

  • Installer roof layout showing every panel on each roof plane. This is the attachment that most often decides the request.
  • Spec sheets for panels and racking, showing colour and mounting height.
  • Photos of the roof from the street and from the yard.
  • Conduit and equipment location marked on the layout or a photo.
  • Installer licence and insurance, and a note that a permit will be pulled.

Common reasons solar requests come back

  • No layout, or panels shown on the street-facing roof with no reason given.
  • Exposed conduit across the front of the house.
  • Silver frames where guidelines ask for black.
  • Missing installer details or permit.
